Welcome to www.fouramsterdam.com and all associated digital services (the “Website”), operated by FOUR Amsterdam B.V. (“FOUR Amsterdam,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the Website and your purchase, receipt or use of any products made available through it (“Products”). By accessing the Website or purchasing Products, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. We may update these Terms at any time. Your continued use of the Website means you accept the updated Terms.

Definitions

In these terms and conditions, the following definitions apply:

  • FOUR Amsterdam: the company FOUR Amsterdam, located at Van Baerlestraat 9-11, 1071 AM Amsterdam, registered with the Chamber of Commerce under number 34193320, VAT number NL812306107B01
  • Consumer: the natural person who is not acting in the course of a profession or business
  • Webshop: the online store of FOUR Amsterdam, accessible via www.fouramsterdam.com
  • Product: clothing, accessories, and related fashion items offered by FOUR Amsterdam
  • Agreement: the purchase agreement between FOUR Amsterdam and the consumer
  • Cooling-off period: the period of 14 days during which the consumer can exercise the right of withdrawal
  • Right of withdrawal: the right of the consumer to withdraw from the agreement within the cooling-off period.

Use of the Website and Applicability of Terms

These general terms and conditions apply to every offer made by FOUR Amsterdam and to every agreement concluded between FOUR Amsterdam and the consumer.

Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated how the general terms and conditions can be viewed.

If the agreement is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically so that it can be easily stored.

You may use the Website only for personal and lawful purposes. You must not:

  • Copy or reproduce Website content
  • Use bots, scrapers or automated tools
  • Access systems without authorization
  • Introduce harmful code
  • Interfere with Website performance or security
  • Misrepresent your identity
  • Use the Website for unlawful activities

Electronic communication with us counts as valid written communication. We may restrict access if you violate these Terms.

Personal data required for ordering

To complete an order, customers must provide accurate personal information including name, shipping address, billing details, email address and payment information. These details are required for order processing, communication, fraud prevention and delivery.

Product Information and Accuracy

1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

2. The offer contains a complete and accurate description of the products offered, including:

- Sizes, colors, and material composition
- Price including all taxes
- Any shipping costs
- The manner in which the agreement is concluded and the actions required for this

3. Images and specifications in the offer are as accurate as possible, but minor deviations cannot be completely ruled out.

4. All images and specifications are indicative and cannot give rise to compensation or termination of the agreement.

Product availability is not guaranteed, and we may update or correct information at any time.

Out-of-stock items

If an item becomes unavailable after ordering, we will notify you. You may choose:

  • A replacement Product
  • A FOUR Amsterdam gift card
  • A full refund

If we do not receive your preference within a reasonable period, we will issue a refund.

Prices, Payment and Agreement

All prices include VAT where applicable and exclude shipping fees unless stated otherwise. Payment methods appear at checkout. Payment must be completed before we ship your order.

If a Product is incorrectly priced due to an error, we may cancel the order. You may choose to continue at the correct price or receive a refund.

Agreement

  • The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set out therein.
  • FOUR Amsterdam will confirm the order by email as soon as possible. As long as the receipt of this confirmation has not been confirmed, the consumer may terminate the agreement.
  • The consumer cannot terminate the agreement if FOUR Amsterdam has already delivered the products.
Order Processing and Cancellation

Customers may request cancellation before the order has shipped. We will confirm whether cancellation is still possible. We may decline or cancel orders due to errors, payment issues, suspected fraud or stock limitations. Refunds are issued for cancelled orders.

Shipping, International Delivery and Transfer of Risk

Orders are shipped to the address provided at checkout.
Delivery times shown during checkout are indicative and not guaranteed unless clearly stated otherwise. FOUR Amsterdam will take reasonable care in packaging and dispatching the Products. FOUR Amsterdam will inform the Consumer as soon as possible if delivery is delayed or cannot be completed as agreed. In the event of a delay or if an order cannot be fulfilled or can only be partially fulfilled, FOUR Amsterdam will inform the Consumer no later than 30 days after the order was placed. In that case, the Consumer has the right to terminate the Agreement without incurring any costs and to receive a full refund.

If delivery cannot occur within 30 days for reasons within our control, you may cancel the order and receive a full refund.

International shipments may require customers to pay customs duties, import taxes or clearance fees. These costs, and any related delays, are the responsibility of the customer. If a package is refused due to unpaid duties, the carrier may return or destroy it. Costs may be deducted from any refund.

EU, EEA and UK consumers: risk transfers upon delivery.
Consumers outside the EU: local mandatory laws may apply differently.

In-store Pickup (Click & Collect)

1. The consumer has the option to choose pickup at the FOUR Amsterdam store at Van Baerlestraat 9-11 in Amsterdam.

2. As soon as the order is ready for pickup, the consumer will receive an email notification at the email address provided by him/her.

3. The consumer must pick up the order within 7 days of receiving notification that the order is ready, during the store's opening hours.

4. After 3 days, the consumer will receive a reminder that the order has not yet been picked up. From this moment on, the consumer has another 4 days to pick up the order.

5. If the order is not collected within the 7-day period:

  • The order will be automatically canceled
  • An administration fee of €15.00 will be charged
  • The remaining amount (purchase price minus €15.00 administration fee) will be refunded within 7 working days

6. The statutory cooling-off period of 14 days begins when the consumer actually picks up the order in the store.

7. Upon pickup, the consumer must present valid identification and the order confirmation (digital or on paper).

8. The risk of damage and/or loss of products is transferred to the consumer at the time of pickup in the store.

Prices, Promotions, Discounts and Gift Cards Promotional codes

1. During the period of validity stated in the offer, the prices of the products offered will not be increased, except for price changes resulting from changes in VAT rates.

2. All prices are in euros, including VAT and excluding shipping costs, unless otherwise stated.

3. The shipping costs will be clearly communicated to the consumer in a timely manner before the agreement is concluded.

Promotional codes may:

  • Have exclusions or minimum spend
  • Be used once unless stated otherwise
  • Not be applied retroactively
  • Not be exchanged for cash

Refunds reflect the amount paid after discounts.

Gift cards:

  • Can be used online
  • Cannot be exchanged for cash
  • Allow any remaining balance to be used for future purchases.
Payment and Right of Withdrawal (EU and EEA) Payment

1. FOUR Amsterdam accepts the following payment methods: iDEAL, credit card, PayPal, Klarna, KBC/CBC, and GiroPay.

2. Secure payment systems are used for online payments.

3. The consumer is obliged to report any inaccuracies in the payment details provided or stated to FOUR Amsterdam without delay.

EU and EEA consumers may withdraw from the Agreement within 14 days of receiving the order. The cooling-off period commences on the day after the Product is received by the Consumer or a representative designated in advance by the Consumer and notified to FOUR Amsterdam. To withdraw, the Consumer must send a clear statement by email or use the model withdrawal form. Products must be returned within 14 days after withdrawal. The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the Consumer.

Conditions of return

Items must be unworn, unwashed, unaltered, undamaged and in original packaging with tags attached. Return shipping costs are the Consumer’s responsibility. FOUR Amsterdam may withhold reimbursement until the returned Product has been received. FOUR Amsterdam uses the same payment method for refunds, unless the Consumer agrees to a different method. Refunds are free of charge for the Consumer. Refunds may be reduced if the Product is used beyond what is necessary to inspect it.

Return Procedure (EU and EEA)

1. The Consumer may register a return via the QR-code on the invoice or by contacting FOUR Amsterdam customer service.

2. Products purchased via the Webshop may be returned by:

a. Sending the Product to the return address (costs approximately €4.00 – €7.00, at the Consumer’s expense)

b. Returning the Product in the FOUR Amsterdam store (free of charge)

3. Products purchased in the physical store may be returned by contacting FOUR Amsterdam customer service for instructions.

4. When returning Products, all items must be returned in their original condition: unworn, unwashed, unaltered, with labels still attached, and including any product packaging and dust bags.

5. The processing of a return may take up to 14 business days. The refund will become visible depending on the payment method used.

Exceptions to Withdrawal

Withdrawal does not apply to:

  • Personalised or custom-made items
  • Underwear or swimwear with broken hygiene seals
  • Items unsuitable for return due to health or hygiene reasons once opened
Warranty, Conformity and Product Care

Products must meet the Agreement and EU standards.

If a Product does not conform to the Agreement, the Consumer is entitled to a free repair or replacement. If repair or replacement is not possible or reasonable, the Consumer may be entitled to a price reduction or termination of the Agreement.

EU Consumers have a 2-year legal warranty.
Defects must be reported within a reasonable period. Two months is considered timely. Depending on the situation, remedies may include repair, replacement, price reduction or cancellation. Always follow care instructions.
Damage caused by improper washing or handling is excluded.
Normal wear and tear is not covered.

Account Creation and Security

Creating an account is optional. If you choose to check out as a guest, providing a valid email address and delivery address is required to process and deliver your order. You are responsible for maintaining accurate information and keeping login details secure. We may suspend or terminate accounts for misuse, fraud or violations of these Terms.

Intellectual Property

All content on the Website, including images, videos, logos, designs, layout and written content, is owned by FOUR Amsterdam or its licensors.

You may not:

  • Reproduce, publish or distribute content
  • Use trademarks without written permission
  • Extract data using automated tools
  • Frame or mirror the Website

Unauthorized use terminates your access rights.

Liability

Nothing limits liability where such limitation is unlawful. To the fullest extent permitted by law:

  • FOUR Amsterdam is not liable for indirect, incidental or consequential damages
  • Total liability is limited to the amount paid for the relevant order
  • We are not liable for delays caused by factors outside our control
  • We are not liable for damage caused by misuse or improper care
Indemnity

You agree to indemnify FOUR Amsterdam against third-party claims arising from misuse of the Website, breach of these Terms, violations of law or infringement of intellectual property rights.

Complaints and Dispute Resolution

Complaints must be submitted as soon as possible and clearly described. FOUR Amsterdam will confirm receipt of the complaint and provide a substantive response within 14 days. EU consumers may use the European Online Dispute Resolution platform. These Terms are governed by Dutch law.
EU, EEA and UK consumers retain rights under mandatory local laws.

Force Majeure

Events such as natural disasters, strikes, transport interruptions, pandemics, government restrictions or severe logistic disruptions may constitute force majeure.
During such events, FOUR Amsterdam is temporarily relieved from its obligations.

General Provisions

We may update these Terms at any time.
Invalid provisions do not affect the remainder. Failure to enforce a right does not waive that right.
You may not transfer your rights; we may assign ours where legally allowed.
These Terms form the entire agreement for online purchases.

We process personal data in accordance with GDPR.
